COVID-19 Protocols for Mediation

By Charles P. Bauer*

1. All mediation participants must socially distance at all times at least 6 feet apart for all seating and standing.

2. All mediation participants should bring a mask and gloves if possible, and use them appropriately during the mediation.

3. All mediation participants should plan to bring their own writing equipment (i.e. pens, pencils, paper), laptops, cell phones, and other electronic devices for drafting a settlement agreement or for other uses.

4. All mediation participants should plan to bring whatever food and drink they may want during the mediation.

5. All mediation participants will be directed to enter and leave the building using only the main entrance door nearest the parking lots.

6. All mediation participants will be directed to go directly into the main meeting room for the mediation joint session, and must continue to socially distance.

7. No contact will be allowed at the beginning or end of the mediation (including handshaking, elbow-bumping, hugging or kissing).

8. All mediation participants will be directed into individual breakout rooms and must continue to socially distance.

9. All mediation participants must not go into other areas of the building - everyone except the mediator must stay in their designated rooms, unless otherwise agreed.

10. All mediation participants will be directed to use designated bathrooms, if needed.

11. Any employees in the building that are not participating in the mediation will be instructed to avoid the mediation areas and participants.
